Individual landlords who are involved in properties to let and small companies are being affected along with larger organisations, as the blame we should all be vigilant, as the culture spreads across the country, by keeping full and accurate records to back things up we can make sure we are not amongst the victims. To ensure you are not breaking any laws it is important to landlords and tenants things are complete in a legal way. Tenants are trying to make money off landlords who are uneducated of their rights, whether you are a tenant, letting agency or investing in property as landlord, it is important to keep complete and accurate timed notes, as it has never been as important as it has been today. Individuals rights has more and more information on the internet, for those who are trying to make a living, the unscrupulous are trying to make quick change out of them.
We had a close call with a tenant recently when they sent a solicitors letter to start a claim and we were able to fend that off with accurate notes. The someone s fault culture is spreading across the country rapidly across all sectors and as money is tight, we are seeing more and more of this, so we need to take note and take action to protect ourselves and as agents, protect our landlords.
A recent case in our management department in Manchester Lettings bought this home to me recently as to why these notes are so important, here is what happened;
A letter was received from a solicitor who had been instructed to act on the behalf of one of our tenant s boyfriends (who was not on the tenancy). The letter was outlining an intention to commence legal action against one of our Landlords (via letting agency) for injury caused by dangerous property.
The gentleman in question was claiming he had been injured after loose plaster from a kitchen ceiling fell down on top of him during a tenancy. The solicitor s letter states the incident happened on the 14th of April and head injuries & soft tissue injuries were obtained as a cause of this incident.
This is a serious complaint and could result in large penalties for the landlord, in damages if the claim was successful.
Our Property Manager checked through our recorded notes on properties to let, which are name and time stamped when created, and it stated:
On the 13th April at 12.02pm Helen Deeley created (Property Management Manager) a confirmation that had been informed our management office was called by a gentleman who abused a colleague verbally of the incident of the injury of someone caused by the ceiling falling down, the notes go on to say furthermore that Helen had contacted the female tenant, who said just a lot of mess was made and also on the incident that nobody was injured. This information was contradicting with the information given by the Male tenant. As this shows the importance for the evidence to be covered, any Buy to Let agencies must keep notes on everything which involves the tenants, landlords or agents.
